I. General Terms and Conditions

§ 1 Scope and General Provisions

(1) These Terms and Conditions apply exclusively to all contracts between you as an entrepreneur (§ 14 BGB) and us, the

(2) These terms and conditions apply exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). Separate general terms and conditions (B2C) apply to contracts with consumers within the meaning of Section 13 of the German Civil Code (BGB), which are available separately on our website.

(3) Any deviating terms and conditions of the customer shall only apply if we have expressly agreed to their validity in writing.

§ 2 Conclusion of contract

(1) Our offers on the website represent a binding offer to conclude a purchase contract.
(2) The contract is concluded via the online shopping cart system by your acceptance of the offer (“Buy” button).
(3) Alternatively, you can request a customized quote. Such a written quote is valid for 5 days.
(4) Processing is automated via email. You must ensure that the email address provided is correct and that receipt is not hindered by technical measures (e.g., spam filters).

§ 3 Individual design

For custom-designed products, you will provide us with suitable print data in a timely manner. You warrant that the data provided does not violate any third-party rights and indemnify us against all claims in the event of a violation. We do not verify its accuracy.

§ 4 Payment methods & credit check

The available payment methods are listed under Shipping & Payment Terms .
If you select the payment method "invoice" or "direct debit," we reserve the right to conduct a credit check to protect our legitimate interests. This will be carried out by the respective payment service provider (Buy Now, Pay Later provider), to whom the necessary company or credit data will be transmitted. Based on the check, we or the payment service provider reserve the right to refuse certain payment methods.

§ 5 Retention of title

(1) The goods remain our property until full payment has been made.
(2) We retain title to all goods until all claims arising from the current business relationship have been fully settled. Resale is permitted in the ordinary course of business, whereby all claims up to the invoice value are assigned to us in advance.

§ 6 Delivery conditions

(1) The delivery conditions, delivery deadlines, delivery restrictions and information on shipping service providers and costs can be viewed at any time at: https://shirtstore.de/policies/shipping-policy .

(2) Delivery times vary depending on the product and are generally between 3 and 10 working days from receipt of payment, unless otherwise stated in the offer.

(3) We strive to always display current stock levels in our online shop to avoid long waiting times . Should an item be unavailable despite careful inventory management, we will inform you immediately.

(4) Delivery shall be at the buyer’s risk.

§ 7 Warranty

(1) The quality of the goods shall be determined exclusively by our product information or the manufacturer’s description.
(2) In the event of defects, we will, at our discretion, repair or replace the goods. Only after two unsuccessful attempts will a claim for a reduction in price or withdrawal be made.
(3) The warranty period is one year from delivery. Excluded are damages resulting from intentional or grossly negligent conduct, as well as legally mandatory rights of recourse.

§ 8 Liability

(1) We are liable without limitation in cases of intent and gross negligence.
(2) In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract.
(3) Any further liability – in particular for lost profits or indirect damages – is excluded.
(4) The limitation of liability does not apply to personal injuries or claims under the Product Liability Act.

§ 9 Choice of law, place of jurisdiction

(1) German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of performance and jurisdiction is our registered office in Berlin.
